University of Embu Chancellor Professor Wambua Musili has lost a bid to stop his arrest and prosecution over issuance of bounced cheques.
Musili had filed an application at the High Court on 19th December 2016 seeking to restrain Cyrus Maina and company advocates and businessman Kennedy Ngumbao from seeking his arrest and prosecution.
The application which was before Justice Fred Ochieng has been dismissed.
Promised to pay
He had promised to pay shs 20 million before 15th July 2016 but failed to do.
His application was dismissed after himself and his lawyer did not turn up in court.
According to Ngumbao, Musili requested for a loan of shs 20million from him and promised to pay.
However, he did not repay the cash as agreed but went on to issue bouncing cheques.
The case is in court and Musili has always defended himself by saying that he acted as guarantor to one of the of his client, Explorer Holdings International Limited who obtained the shs 20 million.
Cyrus Maina and Company advocates and businessman Kennedy Ngumbao have already instituted criminal proceedings against Musili.
