Wajir West constituency election petitioner Ibrahim Sheikh, through lawyer Fred Ngatia, will have to file a formal application for the IEBC constituency returning officer to be recalled.
This is after Ngatia told justice Francis Tuiyot that some of the important pages in one of the polling stations’ diary were missing.
“Some pages are missing in the polling station for Kara polling station which shows different seal numbers,” said Ngatia.
According to Ngatia, some pages might have gotten lost during the time in which a police officer was looking for the investigation officers.
In opposing the recalling of the constituency returning officer to explain why some pages were missing, Issah Mansour, lawyers for one of the respondents, told the court that obtaining such documents can only be done through a court order.
“How did the petitioner come into possession of such documents since all election materials must be sealed immediately after the exercise and can only be opened through a court order?” asked Mansour.
Sheikh Ibrahim, who contested the August 8 2017 elections on a Kanu ticket, is challenging the election of Ahmed Kalosh of ODM citing electoral malpractices during the general election.
