After a terse session characterised by passioned submissions from the defence and the state, a judge finally releases a safety valve and issues fresh summons to police and demands an explanation on how Miguna was deported in disregard of a court order.
Justice Luka Kimaru, whose orders have been defied five times now, demanded that DCI George Kinoti and Flying Squad’s Said swear affidavits in person indicating how Miguna was released from their custody and handed over to Immigration for onward ‘deportation’ to Canada.

He also roped in the Director Of Immigration (Rtd. Maj. Gen.) Gordon Kihalangwa to swear a similar affidavit to show how he acquired “custody of Miguna.”
The said affidavits are to be filed in court by February 9 2018 and Miguna’s lawyers may reply to them before February 15 2018 when the proceedings resume.
Justice Kimaru has equally directed that the DCI Kinoti and the Flying Squad officer Said “show cause why” they should not be punished for contempt of court.
