THE COURT of appeal has upheld the election of Nairobi Governor, Mike Sonko, after throwing out a petition first rejected at the high court.
Three judge said was right is striking out the petition by voters Japheth Moroko and Noah Akala who later lodged the appeal.
Moroko and Akala wanted the petition reinstated on the basis that the election court erred in throwing it out.
The petitioners had argued that Justice Mbogholi ought to have allowed the withdrawal so that anyone willing to take it up can do so.
Moroko and Akala will shoulder costs at Ksh2 million, the judges ruled.
