EACC has been barred from any continued pursuit of former Nairobi governor Evans Kidero by an order of the High Court.
Justice Hedwig Ong’udi ruled that it was illegal for the anti-graft body to continue harassing Kidero during the pendency of a petition he lodged challenging the purported investigations.
“I order no further execution of a search warrant or any other warrant in respect to the petitioner and seized property be released forthwith within the next 72 hours,” the judge ruled.
At the same time the judge also expunged the DPP from the proceedings stating the good office ” has not played any role and has not been cited for any violation by the petitioner…”
“It will not serve any purpose to keep the DPP as a party in these proceedings…” she said.
Kidero had raised the red flag against EACC and accuses the agency of harassment and propagating an economic sabotage in the guise of investigations.
Meanwhile anti-corruption magistrate Doglas Ogoti allowed Kidero to travel to Hong Kong for a month after directing that his passport be released.
